Maybe the child is working at his level -- all children progress at different speeds.
I am sure you have the childīs best interest in mind, but honestly, it sounds as though you have an axe to grind with the mother (at least that is how your post comes across to me).
Let the child go at his own speed -- why stress him more than he likely already is with the change of custody, etc. That is another thought too - maybe the mom didnīt fail the child, maybe he just isnīt good at tests, or is under too much stress with the changes and obvious hostility between caregivers to focus to the best of his ability.
